Sales/Delivery/Lead Times
Bouncers and Bouncers prides itself on our record we have maintained of providing quality equipment to the customer on the dates promised. The promised delivery date is the best estimate possible based on current and anticipated factory loads, of when your order will be shipped. *Shipping Risks: loss, damage or destruction of purchased product is assumed by consignee & not Bouncers and Bouncers once purchased product is placed in the hands of any carrier or freight transportation company that may be used. Bouncers and Bouncers shall not be liable for damage or for delay in delivery arising from causes beyond its control and without its fault or negligence, including, but not limited to, fires, floods, earthquakes, shortage of materials, strikes, freight embargoes, and unusual severe weather.

Bouncers and Bouncers shall not be held responsible for additional freight charges over & above what may have been quoted at the time of order. *It is the responsibility of the customer to unload/break down the pallet from the delivery truck.

Residential deliveries or shipments requiring special handling such as a liftgate truck for unloading Bouncers and Bouncers products may also be subject to additional delivery charges to the purchasing consignee.

Inspection
Buyer shall inspect the goods promptly after receipt.  Any claims of shortage, breach of warranty, damage, or defect is waived by Buyer unless: Buyer submits claim in writing to Bouncers and Bouncers within (3) days of receipt of the merchandise.  Failure of Buyer to give written notice of a claim within the (3) day inspection period shall be deemed to be waiver of a claim for defective products, a waiver of the right to reject the goods, and conclusive proof that the products were received by Buyer without defects.

Return Policy / Warranty
All Sales are final. Buyer agrees to consult with state or local city, county, authorities for any requirements or restrictions prior to purchasing any product from Bouncers and Bouncers.Buyer agrees & fully understand that Bouncers and Bouncers LLC is not registered to sell products in the states of*PA & *NJ All sales are final! All (new) Inflatables purchased carry a (12) month manufactures warranty, *unless specified otherwise on your receipt. *Slide Liners, Pool Liners, Zippers, Velcro, Velcro Suits, Basketball Hoops with nets, boxing gloves are not covered under Bouncers and Bouncers warranty. All shipping charges to and from Bouncers and Bouncers  & or other manufacturers during warranty period are the responsibility of the customer. Photos of any suspected areas are required to be submitted prior to obtaining warranty authorization return to Bouncers and Bouncers.

Bouncers and Bouncers s warranty obligation shall not apply to:
1. Any inflatable which has been subject to negligence, misuse, accident, or misapplication.
2. Any inflatable that has been repaired, modified or altered by someone other than Bouncers and Bouncers.
3. Failure resulting from improper setup or use of inflatable, lack of preventive maintenance or servicing including improper installation, dismantling and/or transporting.
4. Damages caused by prolonged or improper storage of inflatable. I.E. sun, water, mold, or mildew damage.

Cancellations
The Buyer shall not be entitled to cancel their order or any part thereof nor to require delay in its performance without our written consent, which will indemnify Bouncers and Bouncers against all loss.

Tolerances/Color Variations
All dimensions stated are approximate and within industry tolerances. Sizes quoted are to be taken as nominal. By the nature of products being inflated, it is impossible to define exact sizes.
A product shall not be considered defective if it is a different color than shown on Bouncers and Bouncers website or catalog.
Buyer acknowledges that no warranty is made relating to color differences.

Limitation of Remedies
Replacement or repair at Bouncers and Bouncers option shall be the sole remedy of Buyer with respect to any defective or non-conforming goods or parts and shall be in lieu of any other remedy available under applicable law.  Bouncers and Bouncers is not liable for remote, special, speculative, or consequential damages.  Bouncers and Bouncers is not liable for loss of use or profits under any circumstances.
Disclaimer Bouncers and Bouncers disclaims any responsibility whatsoever to buyer or to any other person for injury to persons or damage to or loss of property or value caused by any product which has been improperly installed or maintained, subjected to misuse, negligence, misapplied, modified, or repaired by unauthorized persons:

Use and Indemnification "Buyer" (person, company or entity purchasing the inflatable product or device), is solely responsible for the manner of use of the products and other equipment purchased from Bouncers and Bouncers. "Buyer" is solely responsible for all signs, labels, and warnings to consumers or other users of the products and equipment, and or any and all other acts necessary, including user warnings and limitations (I.E. weight, height, age, number of participants, and medical condition limitations), to ensure the safety of the users. "Buyer" acknowledges that they received, read and fully understand all necessary instructions for the safe setup and operation of their inflatable product or device. "Buyer" agrees to operate their inflatable product or device according to all state and local requirements. "Buyer" agrees to train any person(s) operating the inflatable product or device in the safe operation of the inflatable product or device including safe handling of emergency situations. "Buyer" shall & must use stakes, tie-downs, weight bags, and other applicable devices necessary to ensure the safety of the users and the general public. "Buyer" agrees to indemnify, hold harmless Bouncers and Bouncers and Bouncers and Bouncers Insurers from actions and claims of third parties, including customers of "Buyer" and users of the goods and products sold to "Buyer", arising out of or in connection with the use of the goods and products herein described or resulting from the breach of the provisions in this Confirmation of Order by Buyer. In the event Bouncers and Bouncers is required to commence an action to enforce this provision, Buyer shall pay all of Bouncers and Bouncers legal costs and expenses.

Patents: Bouncers and Bouncers implies no guarantee that the goods delivered are free of any rightful claim of any third party by way of infringement or the like. If Bouncers and Bouncers determines, in its sole discretion, that manufacturing, or selling such products would result in the infringement of any patent or copyright, Bouncers and Bouncers  reserves the right to cease the manufacturing and/or shipping of the product in question.

Insurance: Buyer agrees to carry general liability insurance with coverage limits of no less than $1,000,000 in connection with Buyer’s use or rental of any goods purchased from Bouncers and Bouncers.

Lessee agrees to undemnify, defend and hold harmless Lessor, its agents.Employees and person or entity in privity herewith, from all claims, loss or damage Lessee may sustain as a result on damage to any leased property by any cause. Lessee acknowlegde that persons may sustain injuries using the leased property, and Lesseeassumes all risks and liabilities for the loss of, or damage to the leased property, for the injury to any person orproperty of anther, and for all other risks and liabilities arising from the use, operation condition(delivery and return, if equipment not delivered and returned by Lessor, possession or storage of the leased property while in the possession of the Lessee. Lessee's duty to indemnify the Lessor includes it's duty to reimburse Lessor for all expenses, losses, liabilities, fines, penalties and claims of every type, including reasonable attorney's fees impose on or incurred by Lessor as a result of any of the above contigencies taking place.

Bouncers and Bouncers is Not responsible for any injuries, NO ADULTS ALLOWED IN MOONWALK. Lessee also agreerelmburse Lessor in full for all damage arising from any abuse, misuse or negligent act by Lessee, its employees, agents, guests, invitoes or trespassers.

Bouncers and Bouncers is NOT responsible for weather conditions. During periods of severe weather conditions(i.e. rain , high winds, etc.) we reserve thye right to cancel your reservation. If conditions are not too severe we will give the option of keeping it or not, IF YOU DECIDE TO KEEP THE UNIT FOR THE TERM OF THE AGREEMENT THERE WILL BE NO DISCOUNT FOR REFUND ONCE THE UNIT IS SETUP!

Rentals.Rules.

Adult supervision

Only 10 children at a time on bounce .

No one over of 12 allowed on bounce & slide.

No refunds.

The renter agrees to be responsible for accidents.

The renter agrees to be responsible for any damage or theft of the equipment.

All pets must be tied up.

This is property of Bouncers and Bouncers Llc It cannot be sold,moved or renter to anyone.

Only adults can operate concession equipment.

No silly string.

No piñata papers allowed on inflatable rides.

No water allowed on dry units.

No drugs or alcohol allowed in equipment.

Bouncers and Bouncers and renter inspected the unit and they understand at the moment of setting up the equipment is in perfect condition.

Full rental fee applies of canceled on the spot after setting up.

The renter agrees to hold harmless Bouncers and Bouncers LLC  for any accidents causing injuries or death. Bouncers and Bouncers don't have any liability insurance.

The renter does understand Bouncers and Bouncers  and there employees don't do any negligence.

Bouncers and Bouncers don't be responsable of electrical power ,fences,doors on bad condition, in case of take extra time Bouncers and Bouncers can cancel the rental at any time or charge extra fees .

Note. We accept just cash on rentals fees., NO CHECKS OR CREDIT CARDS.All prices plus tax.
